Terms of Service

By accessing and using ExMarket (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

You must create an account to use most features of the Platform. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information during registration.

  • You may list items and services for sale, exchange, or both.
  • All listings must accurately describe the item or service being offered.
  • You are solely responsible for fulfilling your obligations in any transaction.
  • Prices listed should be fair and transparent.

The following are strictly prohibited on the Platform:

  • Illegal items, stolen goods, or contraband
  • Weapons, drugs, or controlled substances
  • Fraudulent or misleading listings
  • Harassment, abuse, or threats toward other users
  • Spam, phishing, or malware distribution
  • Circumventing the Platform's escrow or payment systems
  • Creating multiple accounts to manipulate ratings

For purchase transactions, payments are held in escrow until the buyer confirms receipt of the item or service. The Platform acts as an intermediary and does not guarantee the quality or condition of items. Disputes can be raised within the transaction flow.

ExMarket Credits (1 credit = NZ$1) are used to pay for listings, carpool rides, and other in-platform services.

  • Topup credits (purchased with money) may be refunded to the original payment method within 30 days of purchase, provided they have not been spent. Once spent, credits are non-refundable.
  • Bonus credits (e.g. signup bonus, carbon-share bonus, promotional credits) have no monetary value, are non-transferable, and are not refundable.
  • Credits do not expire while your account remains active. If you delete your account, any unspent credits are forfeited.
  • Refunds for failed transactions (e.g. driver cancels a carpool ride, seller fails to deliver) are processed automatically as platform credit, not as cash.
  • If the Platform is discontinued, we will give at least 30 days’ notice and offer refunds of unspent topup credits to the original payment method where practicable.

Either party in a transaction may initiate a dispute if issues arise. The Platform will review disputes and may mediate a resolution. Final decisions on disputes are at the Platform's discretion.

Users may rate and review each other after completing a transaction. Reviews must be honest and based on actual experience. The Platform reserves the right to remove reviews that violate these terms.

The Platform is provided “as is” without warranties of any kind. We are not liable for any losses, damages, or disputes arising from transactions between users. We do not guarantee the quality, safety, or legality of listed items or services.

We reserve the right to suspend or terminate accounts that violate these terms. Users may also delete their accounts at any time. Upon termination, any pending transactions will be handled according to our dispute resolution process.

These Terms are governed by the laws of New Zealand. The Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply where relevant — nothing in these Terms limits your rights under those Acts.

Any dispute arising out of or relating to these Terms or your use of the Platform that cannot be resolved through our internal dispute process will be subject to the non-exclusive jurisdiction of the courts of New Zealand.

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or in-app notification.
